FORT WORTH, Texas, April 2 (Reuters) - A Texan who was dubbed the "affluenza teen" is due to be released from jail on Monday after serving nearly two years for killing four people while driving drunk and later fleeing to Mexico with his mother.

The case made headlines worldwide after lawyers for Ethan Couch argued that his wealthy upbringing impaired his ability to tell right from wrong.

Couch, who is being released a few days before his 21st birthday, will remain under strict probation supervision after he is freed from the Tarrant County Jail, the county sheriff's office said.

No time has been set for his release, but the sheriff's office for the county, which includes Fort Worth, begins processing inmates at 8 a.m. (1300 GMT), office spokesman David McClelland said.

Couch was 16 and had a blood alcohol level three times the legal limit for an adult when he struck and killed four people in June 2013 with his pickup truck.

At his trial in juvenile court that year, a psychologist testifying on his behalf described Couch as suffering from "affluenza." The psychologist said it was an affliction brought on by being spoiled by his parents and that it had skewed his moral compass

Couch was sentenced to 10 years of probation, sparking outrage from critics who ridiculed the affluenza defense and said his family's wealth had helped keep him out of jail.

But in late 2015, when a social media video surfaced that showed him in possible violation of his drug-and-drink-free probation, he and his mother, Tonya Couch, fled the United States for Mexico, where the two were later apprehended and deported.

In 2016, a Tarrant County judge transferred Ethan Couch's probation supervision to the adult system and ordered him to serve 720 days in jail, 180 days for each of his four victims.

That sentence was seen as the maximum possible
, given the various legal mechanisms of a case that spanned the juvenile and adult systems, legal officials said.

His mother, 50, had been free on bond while awaiting trial on charges related to aiding her son flee the country. She was sent back to jail last week for violating her probation by failing a drug test, according to online jail records and local law enforcement.

these werent murders they were accidental (at least as 'accidental' as most of the shooting deaths labeled as such - and most of the shooters dont see a courtroom never mind a jail cell)

Was he drunk - certainly and that needs a penalty
was he underage - yes but that is both a mitigating and an aggravating factor.

Two years does seem a little light but not grievously so

Yes, he was drunk, no he is not a minor and he fled off to Mexico that added or supposedly added to the sentence. I read drunk driving with death in the UK is up to 14 yrs. no one see's the inside of a prison? He got 10 yrs probation, he should have spent those ten years behind bars.

I saw the original story, when he was on trial. He was totally unconcerned about having killed all those people while drunk. And the defense was ludicrous. I think he should have had 20 years.

A mitigating factor??? Anyone who gets behind the wheel when drunk should be found guilty of attempted murder in my opinion! Of course I'm a little prejudiced about drunk drivers as my father was killed by one about two weeks before my 6th birthday. I grew up hearing 'jokes' about drunk drivers on TV comedy shows. I never found them very funny for some reason. My father was a Marine who made it through WWII with little or no injury only to be killed by this 'joker'. He was buried on his 35th birthday and left a widow with two small children!

Oh well, my bad - I guess I just have no sense of humor!

I googled to refresh my memory, and found this:

On the evening of June 15, 2013, according to authorities and trial testimony, Couch was witnessed on surveillance video stealing two cases of beer from a Walmart store, driving with seven passengers in his father's red 2012 Ford F-350 pickup truck, and speeding at 70 miles per hour (110 km/h) in a designated 40-mile-per-hour (64 km/h) zone.

Approximately an hour after the beer theft, Couch was driving his father's truck at 70 miles per hour (110 km/h) on rural, two-lane Burleson-Retta Road where motorist Breanna Mitchell's sport utility vehicle (SUV) had stalled. Hollie Boyles and her daughter Shelby, who lived nearby, had come out to help her, as had passing youth minister Brian Jennings. Couch's truck swerved off the road and into Mitchell's SUV, then plowed into Jennings' parked car, which in turn hit an oncoming Volkswagen Beetle. The truck then flipped over and hit a tree. Mitchell, Jennings, and both Boyles were killed, while Couch and his seven teenage passengers (none wearing seat belts) survived (although one was paralyzed), as did the two children in Jennings' car and the two people in the Volkswagen.[18]

Three hours after the incident, Couch had a blood alcohol content of 0.24%, three times the legal limit for adult drivers in Texas,[7] and he also tested positive for marijuana and Valium.[5]

My question is this: Why was this not felony murder (taking a life during the commission of another crime)? Stealing the beer was one crime, which contributed to his drinking over the legal limit; and speeding was another.

Ahem! at 16 he is 5 years short of being legally allowed to drink - and either he is "adult" will all the rights responsibilities and privileges which accrue from that status or he is a minor.

that is the maximum (soon to be replaced with a life sentence) - which is rarely applied.

An early guilty plea will reduce the possible maximum by 30% and mitigating factors will reduce it further and in almost every case only 50% of the handed down sentence will be served in custody

In the UK I wouldnt expect Couch to be sentenced to more than 6 (assuming a guilty plea) and so would serve three - but with a good lawyer and he might get significantly less

So-called 'minor' who kill people can and frequently are tried as adults. In addition to the theft and the speeding violations he was obviously breaking drug laws as well, Mais Oui! His subsequent violation of his parole as well as 'fleeing to escape prosecution' were adult crimes! This is clearly an instance of CASH & CARRY JUSTICE! emoticon

This 'incident' took place in Texas and it's a safe bet that if this kid had been from a poor family of color he would have been tried as an adult and would never have seen the light of day again!
