Second degree murder?


Since when is designing or building an amusement park ride that accidentally results in someone being killed the same thing as second degree murder?

Are the authorities going to claim that the designer of the ride intended for the ride to kill the little boy who was decapitated?

No, they said he lacked technical or engineering expertise. I don't know if it is true but I think it is important. Parents take risks with their kids everyday and they know it and you take certain risks with your child or you don't, everyone has different boundaries. What you should expect is not an accident because of faulty equipment. It's no different than vehicles, we know what can happen but we don't expect "accidents" from poor quality or screw ups, that is why there are recalls and billions of money paid out by car manufacturers when people are injured or die.

Hard to believe there are no regulations requiring such equipment to be safe. And if so, the manufacturer is guilty of some sort of crime.

Of course there are regulations and and apparently this person broke them. It isn't as if only the US experiences these types of deaths.

Thanks Katie, it was hard to believe there were no regulations.
If the manufacturer was deficient then he should be tried.

Yes, but how many car manufacturers who produced cars with dangerous defects were charged with second degree murder when someone riding in one was killed?

I have no problem with him being tried for some violation of the law or safety regulations but I don't see how he can be guilty of second degree murder. Or why he should be charged with that crime.

I highly doubt that he intended for it to be a lethal ride like some kind of maniac out of a horror film. And most of the people who rode on the ride did so safely without being decapitated.

Their lucky day wasn't it, you didn't lose your head. It isn't always an intention that you set out for anyone to die, that doesn't mean you can't be held responsible. I would assume there are plenty of times a person or company didn't "mean it" that may be less a charge as an on purpose but it doesn't mean you escape responsibility for a persons death. I always have sympathy for those who unknowingly was the cause of someones injury or death, it'd be horrid. I don't know what this case is a person who knew his equipment was unsafe or a person who had no clue, either way he will be held responsible, ignorance is not an excuse but I will assume one could have a clearer conscience by thinking the were doing the right thing rather than knowing they did the wrong thing and caused loss of life.

Let me turn this on its head - why would the designer of a piece of equipment which when used according to specifications has a propensity to malfunction and cause fatalities NOT be charged with negligent homicide?

Kansas Second-Degree Murder

Murder is generally defined as the unlawful killing of another with malice (or the desire to inflict injury or harm). However, each state defines murder slightly differently. In Kansas, the crime of murder is broken down into three separate crimes: capital murder, first-degree murder, and second-degree murder. This article provides a brief overview of Kansas' second-degree murder law.

Capital murders and first-degree murders in Kansas are either premeditated intentional killings or classified as felony murder. On the other hand, second-degree murders are either unplanned but intentional killings, or killings caused by a reckless disregard for human life. The following chart outlines Kansas' second-degree murder law.

Code Section Kansas Statutes section 21-3402: Murder in the Second Degree

What's Prohibited? Killing a human being either:
• Intentionally, or
• Unintentionally but recklessly under circumstances manifesting an extreme indifference to the value of human life

Penalties If the killing was done intentionally: Severity level 1, person felony.

If the killing was done unintentionally: Severity level 2, person felony.
