EASY!!!

Had she not have signed the contract she would not have been employed -
 -she was employed therefore she signed the contract!

She may not have read the contract, she may have read and not understood it - but sign it she indisputably did!


(here at least) an employment contract lays out what the employer expects from the employee and what the employee can expect from the employer in return and I cannot believe that they are very much different any where.

If you dont sign the contract you are not agreeing to the hours, the pay-scale, the holidays or anything else if you dont agree to the basic terms what sort of idiot employer would take you on?

I'm with Cro: I want to see the contract before I agree that she violated the contract.

And I (probably) repeat: Was the contract valid? What can an employer legally demand of an employee when the employee is not at work?

And furthermore! What demands that an employer can legally make are in fact Constitutional? Some things cold be unconstitutional which have not yet been found unconstitutional. The Supreme Court exists to find those things.

Her employer is a private enterprise, so how can anything they do be unconstitutional?

I didn't read where she signed a contract, she doesn't mention
 a contract, only freedom of speech, is there a contract?

There may not be an explicit, signed contract, but there's almost certainly at least an implied contract.

folks, she already admitted that she was forced to resign for violating her company social media policy for obscenity.

 that is not the point she knows she violated it. She's suing the company because she claims other employees violated the social media policy and were not fired.

 this is from her complaint.
 
Plaintiff was notified that she was being forced to resign for violating Defendant’s social media policy. A copy of Defendant’s social media policy is attached hereto at Exhibit 2. 35.
 
Defendant’s social media policy defines “Covered Social Media Activity” as “social media activity that … otherwise impacts the Company’s business interests, or that of its parent, subsidiary, affiliated companies, contractors, customers, or competitors… .” Exhibit 2, paragraph 3.2. 36.
 
The policy goes on to provide that: “Covered Social Media Activity that contains discriminatory, obscene, malicious or threatening content, is knowingly false, creates a hostile work environment, or similar inappropriate or unlawful conduct will not be tolerated and will be subject to discipline up to and including termination of employment.”

here is her complaint, she is suing for around 2,600.00 plus interest since she was promised 4 weeks pay, if she would resign. After she resigned she was only given 2 weeks severance pay.

Isn’t the middle finger gesture obscene? Nope. Rude and obnoxious, undoubtedly. But to be classified as “obscene” under constitutional law, the speech has to “appeal to a prurient interest” (Miller v. California, 413 U.S. 15, 1973)—in other words, it has to be sexual in nature.
