What it is, denying free expression, which in school or the job, what else is new. The plaintiff thinks it is which is why they are suing. The defendant maintains it is not. It is up to both sides to present their cases and await the judgement of the court (if they can't reach a settlement out of court.) If they don't like the decision of the court they can appeal. That's how our judicial system works.
