Here's a way of looking at the situation involving the girl that may make what I am arguing a little clearer. Suppose another girl did everything this girl did up to the point of going to the church with a weapon but instead of finding the church unoccupied she found it full of potential victims. Then suppose she developed cold feet and decided not to try to kill anyone. Instead she threw her knife in a garbage can, went into the church and confessed to the congregation begging for their forgiveness.

Based on what you and the state of Georgia are claiming she still could be charged with attempted murder.

It depends ENTIRELY on when she was apprehended, neither the police nor the court can be expected to know what she MIGHT have done had she not been arrested.

with a plan in mind to murder if she arrives at the locus and the police stop her - its attempted murder

with a plan in mind to murder if she arrives at the locus had a change of heart and abandons her plan and dumps the knife then it probably isnt attempted murder (it would still be conspiracy if a second person was involved)


From what I get from your "defence" you are saying that if the police become aware of a murder plot they should wait until at least some of the planned murders have been committed before arresting the suspect because the instant before the suspect pulls the trigger they might have a change of heart and decide not to go through with the plan.


I understand that (here certainly) a lot of police work like that for more minor crimes - they see someone trying car door handles they could arrest for attempted theft BUT its a much stronger case if they wait until the suspect actually enters a car, but I didnt think that anyone would allow a murder to go down just to strengthen a case! (but apparently you would)

Which is why she shouldn't have been charged with attempted murder. When people attempt to murder someone it is known that they have committed that crime.

No, it's taking one step in carrying out a plan to commit murder. Not the same thing as attempted murder.

It's not attempted murder in either case unless the crucial step of actually attempting to murder someone takes place.

I'm not saying this girl shouldn't have been arrested, only that she shouldn't have been charged with attempt to commit murder. That's because she didn't actually attempt to commit a murder.

Not at all. I believe in officials taking murder plans and threats very seriously. That doesn't include charging people with crimes they didn't commit.

Go to 12:45 to minute 20 to have a lawyer explain it, (both Trump's crime of attempted extortion and the legal point about Philler's case that he just refused to understand )

Taking just one or two steps to commit murder is not attempting to commit murder unless they are the only steps required to do so.

An attempt to commit murder requires doing something that if done effectively will result in someone being killed. What the girl did was plan to commit a crime and go to a location to find potential victims. She completed both of those steps but neither falls into the category of an action that when completed effectively will result in someone being killed.

Baloney. Such a person would not have taken any action that if completely effectively would have resulted in a robbery.

Suppose a woman plans to shoot her husband, goes to a gun shop, buys a gun and then goes home waiting there for her husband. Has she attempted to commit murder?

As I explained to Geezess, an attempt to commit murder requires taking an action that if completed effectively will result in someone being killed. Everything the woman did in the above scenario would not result in someone being killed. Further action would be required just as further action would be required in the case of the would-be armed robber.

Nothing the girl did in the case we've been discussing would have or could have resulted in someone being killed so it couldn't possibly qualify as an attempt to commit murder.

Um,plotting to kill someone whether you carry through is a crime., it is called conspiracy to commit murder. You may not agree but if caught it is still a crime and you are going to jail. I'm beginning to think if the crimes you posted by women who you give a pass, if committed by a man you'd come unglued, actually I'm not beginning to think it, I know it.
